Stay of collections

You can pause IRS collections by requesting a Collection Due Process hearing within 30 days of a final notice, asking for hardship status, or submitting a payment plan or offer. Each one stops most collection while it is open. Blaga Veleva, EA, picks the request that fits your letter and files it with the IRS for you.

What should you do this week to stop IRS collection?

Match your latest letter to the right request. If you have an LT11 or Letter 1058, a CP90 or a CP297 dated within 30 days, the hearing request is the strongest step. If the deadline passed, other routes remain. Sign Form 2848 so Blaga can call the IRS today and see what actions are open on your account.

What is a Collection Due Process hearing?

It is your right to an independent review before the IRS levies, or after it files a lien. You request it on Form 12153 within 30 days, using the date printed on your letter. The IRS CDP FAQs say Appeals needs a financial statement, Form 433-A or 433-B, to consider alternatives. At the hearing you can propose a payment plan or offer, or dispute the debt in some cases.

Can you get IRS collections paused for hardship?

Yes. If you can't pay basic living expenses, the IRS may place your account in Currently Not Collectible status. Its temporary delay page says it then suspends most collection. You still owe the full amount, penalties and interest continue, a lien may be filed, and refunds may be applied to the debt. The IRS may ask for Form 433-F, 433-A or 433-B with proof.

Which other requests pause collection?

  • Payment plan request. While it is pending, the IRS is generally prohibited from levying. See installment agreements.
  • Offer in compromise. Most collection is suspended during review. See offer in compromise.
  • Innocent spouse request. The IRS can't collect from you for that year while it is pending. See innocent spouse relief.
  • Collection Appeals Program. After a CP504, you can ask for a CAP appeal before collection action takes place.

Each request has its own form and its own proof. Filing the wrong one wastes time you may not have.

What if the IRS has already levied?

You can still ask for a release. The IRS may release a levy causing an immediate economic hardship, or one issued in error. For a bank levy, the 21-day hold is your window. See IRS levy and wage garnishment for the steps. Bring the levy notice and recent bank statements to the first call.

How does Blaga Veleva request a pause?

She reads your notices and transcripts, files the hearing or appeal request on time, prepares the financial statement, and speaks to the IRS for you. You get one clear plan instead of a pile of letters. Not sure which letter is the latest? Bring them all. The dates on the letters decide which requests are still open. Start with a free consultation at the FM 1960 West office or by secure portal.

Does a pause stop the 10-year collection clock?

Sometimes it extends it. The IRS generally has 10 years from assessment to collect, but that period can be suspended or extended. A payment plan request suspends it during review, and an offer in compromise extends it. That trade is usually worth it, but it should be a choice you make knowingly. Blaga reads the dates on your transcript before filing any request. See back taxes for more on the collection period.

Keep filing and paying current taxes on time. A new balance can undo a hardship status, a plan, or an offer. If you are self-employed, keep up with estimated payments. Our tax preparation service can handle this year's return so the old problem doesn't grow.

Questions

Questions people ask

Q1How do I pause IRS collections?

Request a Collection Due Process hearing within 30 days of a final notice, ask for hardship status, or submit a payment plan or offer in compromise. Each pauses most collection while it is open.

Q2What is a Collection Due Process hearing?

An independent review by IRS Appeals before a levy or after a lien filing. You request it on Form 12153 within 30 days of the final notice or lien letter. The deadline is printed on your letter.

Q3Does hardship status make the debt go away?

No. Currently Not Collectible status pauses most collection, but you still owe the full amount, and penalties and interest keep growing.

Q4Can I still get a hearing after the 30 days?

For a lien letter, the Taxpayer Advocate Service says you may request an Equivalent Hearing within one year of the notice date, though you generally can't go to Tax Court afterward.
